Welcome to Instanced ("Instanced", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Instanced platform, available at instanced.net (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Use of the Service

Instanced provides a powerful platform for managing infrastructure, workflows, agents, and organisational operations.

You acknowledge that the Service enables high levels of automation and control, and must be used responsibly.

You agree to:

  • Use the Service only for lawful purposes
  • Maintain the confidentiality of your account credentials
  • Be responsible for all activities under your account
  • Ensure that your use complies with all applicable laws and regulations

You must not:

  • Attempt to gain unauthorized access to systems or data
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the platform to deploy malicious software or conduct illegal activities
  • Use agents or workflows to generate spam, abuse systems, or exploit third parties

We actively monitor for misuse, abuse, and harmful activity. We reserve the right to investigate, restrict, or terminate accounts engaging in such behavior.

2. Accounts and Organisations

To use Instanced, you must create an account and may create or join an organisation.

  • You are responsible for all actions taken within your organisation
  • You must provide accurate and complete information
  • We reserve the right to suspend or terminate accounts that violate these Terms
3. Infrastructure and Agent Execution

Instanced enables deployment of infrastructure, services, and AI agents.

You acknowledge and agree that:

  • You are fully responsible for all configurations, deployments, agents, and workloads you create or operate
  • The owner, creator, or operator of any agent is solely responsible for that agent's actions, outputs, and consequences
  • You bear all risks associated with deployed code, agents, and automation
  • Misconfigured systems or autonomous behaviour may result in downtime, data loss, legal exposure, or security incidents

Instanced does not control and is not responsible for the behavior of user-created agents or infrastructure, and shall not be liable for any damages resulting from their operation.

4. Acceptable Use and Abuse Prevention

Instanced is a tool of significant power. Misuse of the platform is strictly prohibited.

You agree that you will NOT use the Service to:

  • Send or facilitate spam, unsolicited communications, or bulk messaging abuse
  • Conduct phishing, fraud, or deceptive practices
  • Generate or distribute malware or exploit systems
  • Engage in harassment, abuse, or harmful automated behaviour
  • Circumvent safeguards, rate limits, or security controls

We implement safeguards, monitoring systems, and enforcement mechanisms to detect and prevent abuse. These may include automated and manual review of activity.

We reserve the right to:

  • Suspend or terminate access without notice for violations
  • Limit usage, throttle workloads, or disable agents
  • Report unlawful activity to appropriate authorities
5. Data and Content

You retain ownership of all data, code, and content you submit or generate using the Service ("User Content").

By using the Service, you grant us a limited license to:

  • Store, process, and transmit your data as necessary to operate the Service
  • Monitor usage for security, abuse prevention, reliability, and performance purposes

You are responsible for:

  • Ensuring you have rights to all data you upload
  • Maintaining backups where necessary
6. Service Availability

All fees are non-refundable unless otherwise stated.

  • No system is completely secure
  • You are responsible for securing your credentials and configurations
  • You should follow best practices when deploying infrastructure
9. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

  • You violate these Terms
  • Your use poses a risk to the platform or other users
  • Required by law or regulatory authorities

Upon termination:

  • Your access will be revoked
  • Data may be deleted in accordance with our Privacy Policy
10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind.

We disclaim all warranties, including:

  • Fitness for a particular purpose
  • Merchantability
  • Non-infringement
11. Limitation of Liability

To the maximum extent permitted by law:

  • Instanced shall not be liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you have paid (if any) in the preceding 12 months

You agree to indemnify and hold harmless Instanced from any claims, damages, or losses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your deployed infrastructure, agents, or content
13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms from time to time.

  • We will notify you of material changes
  • Continued use of the Service constitutes acceptance of updated Terms
